Florida education officials have pushed back against a lawsuit challenging the legality of the state's school voucher system, arguing that any harm caused by the program is not their responsibility. In a 40-page legal response filed this week, attorneys for the state countered the Florida Education Association's lawsuit, which was brought in May. The state's lawyers claim the union's case is built on "speculative" damages and that the relief sought by the plaintiffs would not actually be achieved through the legal action they have taken.
The lawsuit, filed by the state's largest teachers union, argues that the voucher program diverts public money to private schools without proper oversight, potentially violating the Florida Constitution's guarantee of a uniform public education system. The union contends that the program drains resources from public schools, leading to larger class sizes and fewer services for students who remain in the traditional system.
In their response, state attorneys wrote that the alleged damages are too vague and hypothetical to support a lawsuit. They also argued that the union cannot prove the voucher program directly caused any specific harm to public schools or students. The legal back-and-forth is expected to continue as both sides prepare for the next round of arguments in court.
